A restaurant owner in West Virginia will be prosecuted
for having slot machines in his restaurant. Currently the owner’s lawyers
are working on an appeal to the courts decision to prosecute the owner
because of the slot machines. There are a few interesting circumstances
surrounding owner’s case.
The restaurants previous “unconventional activities” have been allowed by
the court—but the court then voted against allowing the owner to expand
without specifically stating anything about the slot machines.
Recent legislation that was put into effect after the slot machines were in
place in the owner’s restaurant is now being used against him. The new
ordinance covers how far slot machines must be from places like schools,
churches, etc. But the catch for the restaurant was that they were cited for
violation of the ordinance before they could have possibly been expected to
comply.
The owner’s lawyers are trying to strike a deal where the owner will owe a
fine for every day that he has the slot machines in his restaurant, every
day that he is not in compliance with the ordinance, however the court is
refusing any appeal.
