When it comes to gambling, even on slot machines, there
are no hard and fast rules that determine what will be considered legal and
what isn’t. There is much confusion as to what is – and each state operates
differently. Alabama is one of those states that has found that previous
rulings are only hurting them in making clear and cut decisions.
In the 1890’s a rule was passed that made “no purchase necessary.” While
this might seem simple enough, there are ways around it. Obviously a game
such as bingo is exempt, as is the lottery – all states allow those.
However, what about slot machines, or baccarat tables? These clearly are
gambling institutions – or are they? The State of Alabama just found out the
hard way, that not everything-even slot machines- is as it seems.
The Jefferson County Sherriff charged a race course with the operation of
illegal slot machines. The judge however, saw it differently. As the slot
machines were “electronic readers” and part of a sweepstakes, they were not
actually gambling. This then opens a whole new Pandora’s Box for everyone
else, who will now also find a way around the gambling rule by using the
same type of slot machines.
