In a move to stop the slot machine elections in Guam
from taking place in a mere week, the anti-gaming, anti- slot machines, and
anti-casinos group, Lina’la Sin Casino filed a slot machine challenge to the
federal court to remove the slot machine Proposal B from the ballot on
November 7th.
The slot machine case began in the lower courts, then was brought to the
Superior Court of Guam. The rationale from the anti-slot machines group was
that some of the elements of the challenge involved federal law. That
appeared not to be the case though when the District Court of Guam Chief
Judge Frances Tydingco-Gatewood ordered the challenge back to the local
courts.
According to Tydingco-Gatewood, the legislation concerning the slot machines
only involves a minor amount of federal issues, and the majority of the
elements of the challenge focus on local law. The slot machines issue has
now yo-yo’d between the federal court and the Guam Election
Commission—neither one believes the slot machine issue is their
jurisdiction.
As a way to address this slot machine challenge once and for all, Superior
Court of Guam’s Judge Arthur Barcinas has announced that he is holding a
hearing to discuss this challenge, and how to proceed.
So why is this slot machine debate being pushed so hard? With voting just
around the corner, slot machines are the top priority for Lina'la Sin
Casino. They are firmly against Proposal B which would bring slot machines
to the Guam Greyhound Park in Tamuning. slot machines
